In Ukraine, bloggers are required to mark their stories with an advertising mark

In Ukraine, bloggers were required to mark stories in the form of «reviews» and «unpacks» with an advertising mark.

Corresponding amendments to Law 3136-IX «On Advertising» were adopted by the Verkhovna Rada at the end of May this year and entered into force on October 2, 2023.

Anna Isakova, a blogger from Mykolaiv, commented on the new rules for advertising on her Instagram page. She believes that these new restrictions will make advertising less acceptable to viewers and create additional difficulties for bloggers.

— It is not enough that we pay taxes, now they need signs (advertisements — ed.). Now ads will be harder to come by. There will be no back-stories… delusion. There is nothing else to do in the country. Why don’t we annoy bloggers?— Anna Isakova wrote in her stories.

As you know, definitions of user content (posts and videos in social networks) appeared in the new advertising legislation. In addition, promotion of goods or services not only for money, but also for other forms of remuneration will be considered advertising.

This means that from now on, «reviews», «unpacking» of bloggers will also be advertising, even if a person does not receive money for it, but, for example, a discount or advertises in «barter». Bloggers must mark such content. Therefore, any violation of this law may result in a fine equal to five times the cost of advertising.

We would like to remind you that from July 11, 2023,  a complete ban on advertising of smoking devices (such as Iqos, Glo and others), electronic cigarettes, liquids and containers for them will come into effect in the Mykolaiv region and throughout Ukraine.
