Dissolution of the executive committee in Domanivka: deputies threatened to hold a session without the head of the village council if he does not respond to the appeal

Deputies of the Domanivka settlement council threaten to hold a session without the head of the settlement council, Viktor Vlasiuk, if he does not schedule a meeting himself within two weeks.

We will remind that the deputies have already demanded to hold an extraordinary session in order to make a decision on the dissolution of the executive committee. However, the chairman of the Domanivka settlement council, Viktor Vlasiuk, went on sick leave, ignoring the appeal of the deputies.
«According to Article 13 of the Law of Ukraine «On the Status of Deputies of Local Councils», «local bodies of executive power, local self-government bodies and their officials» are obliged to consider the appeal of deputies and provide an answer within ten days. «Unfortunately, until now, in violation of the legislation of Ukraine, the deputies have not received an answer to their appeals from the village head, the secretary of the village council or another official of the village council,» the document says.
Therefore, the deputies once again sent an appeal with the demand to convene an extraordinary session of the Domanivka settlement council of the eighth convocation, to consider the issue of the report of the executive committee on the performance of powers in 2021-2023, as well as the issue of the dissolution of the executive committee.
This time, the deputies note that if there is no response, they will hold a session without the head of the village council in accordance with Article 46 of the Law of Ukraine «On Local Self-Government in Ukraine». Paragraph six of this article states that in case of unmotivated refusal of the chairman of the settlement council or his inability to convene a session, the session is convened by the secretary of the settlement council.
The ninth point stipulates that if officials do not convene a session within a two-week period at the request of the deputies, the session may be convened by the deputies themselves, who constitute at least one third of the composition of the council, or by the permanent committee of the council.
We remind that on October 20, the deputies voted to dissolve the executive committee. However, the decision was suspended by the head of the village council Viktor Vlasiuk. The order states that the decision-making procedure was violated, and it is also illegal, because it «does not contain any legal justification».
