The Mykolaiv prosecutor's office returned the pond and land to the community: the tenant used the plot illegally

The Mykolaiv District Prosecutor's Office returned the 21-hectare plot of land with the pond to the ownership of the community. The reservoir was abandoned and almost dried up. The tenant used the plot without proper documents and did not pay the rent.

This was reported in the press service of the prosecutor's office.

According to the law enforcement officers, for years the pond was under the control of the lessee, who not only ignored the terms of the contract, but also did not have a passport of the water object — a document without which the use of water bodies is illegal.

According to experts, in recent years Ukraine has experienced significant drying of territories, the area of dry and very dry zones has increased by 7%, in particular due to military operations. The explosion of the Kakhovka HPP, which destroyed the Kakhovka Reservoir, also significantly affected the water resources of the southern regions, including Mykolaiv Oblast.

The prosecutor's office appealed to the commercial court with a demand to terminate the lease agreement and return the land plot together with the pond to the ownership of the community. After the opening of court proceedings, the tenant refused the plot. The land and the water object were returned to the ownership of the community, the court proceedings were closed.

«All of the above indicates a real tense situation with water on the territory of the country, which is worsening due to natural and anthropogenic factors. Water protection requires maximum efforts by both the state and society, including by ensuring the proper functioning of water bodies, preventing their use in a way that can lead to water pollution or depletion,» the prosecutor's office said in a statement.

We will remind you that recently in the Pervomaisk district of the Mykolaiv region, the prosecutor's office sent a case to the court against a resident of the Kryve Ozero territorial community, who voluntarily occupied a plot of land near the Southern Buh river.

Previously, the state managed to return the lands of the National Nature Park Buzkyi Hard in the amount of almost 148 million hryvnias. The Pervomaisk City District Court satisfied the claim for the return of 14 hectares of nature reserve fund land to the state.
