«Deviation from the norms of the regulation», the head of the legality commission of the Mykolaiv Regional Council on personnel appointments at an online session

The head of the permanent deputy commission of the Mykolaiv Regional Council on protection of human rights and freedoms, legality and law and order, Denys Andrieiev, admitted that the presentation and consideration of personnel issues at the online session of the regional council violates the current regulations of the council.

Yesterday, December 11, acting Anton Tabunshchyk, the head of the Mykolaiv Regional Council, signed an order on convening an extraordinary session of the Regional Council on December 14, which will be held remotely.

At the session, they plan to consider personnel issues, in particular, the appointment of the director of the utility company Pharmacy without competition. Also, according to the information of NikVesti, they plan to introduce the issue of the approval of three chief doctors of regional medical institutions on a non-competitive basis. One of them is the head of the regional children's hospital Oleksandr Plitkin, who was searched by law enforcement officers in a theft case on November 30. These issues were discussed at the regional council's standing commissions last week.

In accordance with Article 69 of the Regulations of the Mykolaiv Regional Council, at remote meetings of the session of the Regional Council, as well as standing commissions, only issues of urgent amendments to the regional budget, other issues related to urgent work to eliminate the consequences of emergency situations, other urgent issues, as well as procedural issues can be considered.

This norm is also contained in the final provisions of the Law of Ukraine «On Local Self-Government in Ukraine»:

4) The agenda of remote meetings may include only issues of urgent amendments to the local budget, other issues related to urgent work to eliminate the consequences of emergency situations or the fastest possible elimination of particularly severe emergency situations caused by outbreaks, epidemics and pandemics, or the exercise of powers related to related to such circumstances, procedural issues».

«We now have a state of war, when the regulations were adopted in 2020, no one could have predicted that we would have such a situation, that is why the regulations did not provide for it. And now we cannot come to an agreement on making changes to the regulations. At many meetings, I drew the attention of the previous chairman of the regional council to this, but there was not enough initiative to make corrections. I understand that everyone is guided by the fact that we have martial law. The agenda is approved by a majority vote of deputies. If the deputies believe... From a legal point of view, this is a slight deviation from the rules of the regulation. From a rational point of view, this is a different issue,» said Denys Andrieiev.

Earlier it was reported that the Mykolaiv Regional Council, taking advantage of the martial law, initiated the appointment of three heads of regional hospitals without competition.

We are talking, in particular, about acting the chief physician of the Mykolaiv Regional Children's Clinical Hospital Oleksandr Plitkin, who was searched a week ago by law enforcement officers in the case of property appropriation and forgery of documents. They are also planning to approve the acting the director of the regional blood transfusion station Valerii Chiniakov and the regional skin and venereology dispensary Iryna Maksymova. The Mykolaiv Regional Council is the initiator of the decision projects. In the explanatory note to the draft decisions, it is indicated that their purpose is «to regulate the appointment of the head of a communal non-commercial enterprise in the field of health care, which performs the most important function of organizing the provision of medical care in conditions of martial law».
