The Mykolaiv Regional Council wants to approve three chief doctors without a competition

The Mykolaiv Regional Council, taking advantage of the martial law, initiated the appointment of three heads of regional hospitals to the post without competition. Relevant draft decisions are considered at meetings of permanent commissions and are planned for consideration at the next session of the regional council, NikVesti reports.

We are talking, in particular, about acting the chief doctor of the Mykolaiv Regional Children's Clinical Hospital Oleksandr Plitkin, who was searched by law enforcement officers a week ago in the case of property appropriation and forgery of documents. They are also planning to approve the acting post for the position outside the competition. the director of the regional blood transfusion station Valery Chyniakov and the regional skin and venereology dispensary Iryna Maksymova.

The Mykolaiv Regional Council is the initiator of the decision projects. In the explanatory note to the draft decisions, it is indicated that their purpose is «to regulate the appointment of the head of a communal non-commercial enterprise in the field of health care, which performs the most important function of organizing the provision of medical care in the conditions of martial law.»

On December 4, the question of the expediency of making such a decision and approval on a non-competitive basis of chief doctors of regional medical institutions was discussed at a meeting of the regional council's deputy commission on health care.

As it turned out, the contracts with the chief doctors, who are proposed to be approved for the position outside the competition, expired in June-July of this year.

«Why did the question of appointment arise today? No one canceled the provisions on tenders, why are we now suddenly, out of the blue, six months later appointing a manager? Have we already eliminated the need for competitions? Will they no longer pass at all? Why can't they fulfill their duties until the end of the war? What is the point of appointing the head of the session, and not the acting one? Then why not collect and appoint all of them?», voiced the deputy Svitlana Fedorova during the commission meeting.

The head of the commission, Iryna Shabilianova, in her turn noted that during martial law it is impossible to hold a competition to fill a position, and she explained the need for approval for a position outside of a competition with the bureaucracy associated with the need for heads of institutions with the prefix «acting». renew documents every two months.

«Competitions are not held during martial law, as far as I know. And then already after the end of martial law within six months, the regional council must hold a competition for the position. I will say, since I am the acting director, that every two months you go through a new round of redistribution of documents,» said Iryna Shabilianova.

During the discussion, Iryna Shabilianova also noted that the proposal for the need to approve the post until the end of martial law was put forward by the regional health care department.

Svitlana Fedorova insisted that it is illegal to appoint chief doctors without a competition.

«Acting» is extended for the duration of martial law, and there is no such thing in the law to appoint without a competition for the duration of the period. Whether there is a war or not — it is appointed through a competition. When the war ends, we will hold contests. Why are we going to break the law now?,» said Svitlana Fedorova.

She added that she considers it inappropriate to appoint chief doctors without competition, even during martial law.

Svitlana Fedorova cited as an example the decision of the head of Odesa RMA, who, according to her, appointed the heads of regional health care institutions until the end of martial law.

«Let the leader by his order... He does not translate for the session. The session is the body that conducts the contests, is responsible for the people that we all appointed. If we want to give full powers to some manager, there can be an order for that, and there are precedents for this in other areas. Either it will be the responsibility of the regional regional administration by its order, or the session will decide as prescribed in the law — through a competition,» suggested Svitlana Fedorova.

It should be noted that if the session approves the chief doctors in the position without the prefix «acting», then their dismissal will be possible only by the decision of the session of the Mykolaiv Regional Council.

As a result of the vote, the opinions of the deputies — members of the commission were divided, so the commission did not make a decision on consent to bring to the session issues regarding the approval of hospital managers.

On November 30, the place of work and residence of the chief doctor of the regional children's hospital, Oleksandr Plitkin, and his deputy, Iryna Tkachenko, were searched as part of criminal proceedings under Part 4 of Article 191 of the Criminal Code (Empropriation, embezzlement of property or taking it by abuse of official position). Part 4 of the article defines deprivation of liberty for a period of five to eight years with deprivation of the right to hold certain positions or engage in certain activities for a period of up to three years for wasting someone else's property in large amounts or under martial law.

At the same time, the police reported that the pre-trial investigation continues under one more article of the Criminal Code of Ukraine, namely part 2 of article 366 of the Criminal Code: drawing up, issuing by an official of knowingly false official documents, entering knowingly false information into official documents, other falsification of official documents, which caused serious consequences. It is punishable by deprivation of liberty for a term of 2 two to 5 years with deprivation of the right to hold certain positions or engage in certain activities for a term of up to 3 years, with a fine of 250 to 750 of the tax-free minimum income of citizens.

Oleksandr Plitkin, who the day before was searched by law enforcement officers in a criminal case regarding the possible forgery of documents and appropriation of property, says that they "poured dirt" on him, and the police «are telling us something ephemeral.»

We will remind you that in July 2023, during a visit to Mykolaiv, the President of Ukraine Volodymyr Zelenskyy visited the regional children's hospital. Then he criticized the condition of the wards in the medical institution. While in one of the wards, Volodymyr Zelenskyy drew attention to the fact that the room was not adapted for a comfortable stay there. In particular, the ward lacks cornices, curtains, and air conditioning. After President Volodymyr Zelenskyy's criticism of the condition of the wards in the Mykolaiv Regional Children's Hospital, the institution began repairs in the surgical department and installed air conditioners in eight wards.

On August 16, the State Bureau of Investigation reported the discovery of a large-scale scheme to make money by issuing «false» medical certificates of unfitness for military service at the Mykolaiv Regional Mental Health Center. According to the investigation, this «business» was organized by the director of the medical institution, Viktor Taran, involving subordinate doctors who produced the necessary certificates, and a law enforcement officer who was engaged in the selection of clients.

However, the acting director of the Mykolaiv Regional Mental Health Center, Victor Taran, who, according to the SSU, organized a scheme for the production of certificates for mobilization evaders, remained in his post.

In September, the prosecutor of the Mykolaiv region, Dmytro Kazak, reported that there is currently only one suspect in the case of issuing «false» certificates in a mental hospital — a law enforcement officer, who, according to the State Bureau of Investigation, was an intermediary.
