The Central District Court of Mykolaiv has ordered a businesswoman to return a plot of land owned by the local authority on Sadova Street, by removing the unauthorised extension she had built onto her shop.

This was reported by the legal department of Mykolaiv City Council.

The case concerns a 77-square-metre plot of land that was unlawfully occupied by the construction of a 7.1-by-9-metre extension to a non-residential grocery shop.

By a ruling of the Central District Court of Mykolaiv dated 20 January 2026, the City Council’s claim was upheld. The defendant was ordered to return the land plot in a usable condition, specifically by dismantling the extension at their own expense.

The city council noted that the court recognised the structure as unauthorised construction, despite its state registration.

«The court established that the extension is an unauthorised structure to which the defendant has not acquired ownership rights,» the legal department’s statement reads.

The department added that the unauthorised use of the land plot violated the property rights of the Mykolaiv territorial community as the landowner and prevented the city council from using and disposing of it.

As a reminder, the executive committee of the Mykolaiv City Council approved the installation of a mobile temporary structure on the corner of Shevchenko and Soborna streets. In addition, the city plans to dismantle 12 temporary structures in the Zavodskyi, Inhulskyi and Central districts that lack the necessary permits.
