The State Architectural and Construction Control Authority has not inspected the shelter at Lyceum №38 in Mykolaiv, where work has been unable to be completed for the third year running. The Public Prosecutor’s Office is now seeking a fine of nearly 2 million hryvnias from the contractor through the courts.
As a reminder, the contract for the reconstruction of the shelter was awarded to the company «Master Bud-Montazh», registered in Mykolaiv with a capital of two thousand hryvnias. The contract was worth almost 20 million hryvnias. The work was not completed on time and additional agreements were signed. However, the shelter is still not ready. The Public Prosecutor’s Office is now taking legal action against the contractor.
During a briefing on 18 March, Olena Tuova, head of the Mykolaiv Department of State Architectural and Construction Control, answered a question from NikVesti about whether the department was aware of the problematic shelter and whether it had carried out an inspection there.
According to the head of the department, it is unknown whether the contractors even applied for permission to carry out the work.
«I’m not even sure they submitted documents to obtain planning permission,» noted Olena Tuova.
As she explained, there are types of construction for which documents must be submitted: major repairs, new construction, and reconstruction. But in the case of Lyceum №38, the firm may have taken a different route.
«They could have done it under routine maintenance. They could have done it under Resolution №406, which grants the right not to obtain permits for certain types of work,» added the head of the State Architectural and Construction Inspection.
Olena Tuova noted that since the start of the war, restrictions have been in place regarding inspections: checks can only be carried out with the consent of the relevant ministry.
«They (the ministry, — note) only give consent if a person proves that there is a threat to their life and health. In such a case, we receive an application and convene a commission. The person says there has been a breach of urban planning legislation, and explains where they believe this lies. If you say you are unhappy with a fence at a construction site, then we will only inspect the fence,» Olena Tuova gave as an example.
